Please be assured that we take privacy very seriously and are committed to safeguarding personal information. This notice describes our Privacy Policy and covers the personal information that we collect at our autobrain.com website and through use of the Autobrain System. This Privacy Policy applies to anyone who interacts with the Autobrain System (the “System”), which includes use of, or visits to, the autobrain.com website and all subdomains thereof (the “Site”), purchase or use of the OBD device (the “Device”), use or interaction with the Autobrain mobile application (the “App”) and use or purchase of all services provided by Autobrain, its partners and/or affiliates (the “Services”). By visiting our Site or using our Device, App or Services, you accept the practices described in this Privacy Policy.

Types of Personal Information Collected. In order for you to utilize our System and benefit from our technology, Autobrain must collect certain information from you and store it in our database and servers.

Autobrain collects and maintains personal information provided to us by individuals who visit our Site, register with our Site, subscribe to our Services, subscribe to our mailing list, or who otherwise send us personal information. Such information may include a user’s name, business or home address, phone number, fax number, e-mail address, billing information, educational background, employment history and professional experience, or any other information that a user may give us. We may also collect and maintain account access information for use of our System, including login ID and passwords.

We also collect and maintain vehicle information, including vehicle location and speed, identification information, diagnostic information, vehicle description, and other information about your location, vehicle and driving behavior which may help us provide the features of our Service. We collect and maintain a log of communications between you and us. Autobrain may also collect and store the Internet Protocol (“IP”) addresses of individuals that visit our site. An IP address provides general statistical information, such as browsing activity, areas of interest on the site, general demographic information and other basic information that we will use for system administration. We use such information to make our site more interesting and useful to you, and to assist us in preventing hacking and other malicious activity.

We also may collect personal information passively through the use of cookies and other technology. We use cookies to track the pages of the site that you have visited in order to measure activity on the site and determine which areas and features of the Site are most popular.

Use and Disclosure of Personal Information.We use the personal information that you disclose to us, and information collected from you, your vehicle and your communication with us, to allow you to use the features of the System, perform the Services that you have requested of us, respond to your inquiries, analyze trends and statistics, including your driving and/or vehicle performance, update the Site and features, and support our customer relationship with you. Information provided in connection with subscribing to our services will only be disclosed to third party financial institutions as necessary to process your subscription to our System.

If you request to be put on our mailing list, we will use the information that you give us to send you announcements and other materials from time to time. Each e-mail you receive from us will give you the option to unsubscribe. You can also request to be removed from our mailing list at any time by sending an email to unsubscribe@autobrain.com. We do not sell or rent personally identifiable information to third parties. We only share such information with third parties who provide Services to Autobrain or partner with us, to the extent necessary to provide you with Services or information that you request of us or to analyze trends and statistics relating to our System. These partners do not have any right to use your personal information beyond what is necessary to assist us. We reserve the right to provide such information to our employees, contractors, agents and designees to the extent necessary to enable them to perform certain website-related services (such as web hosting or maintenance services) on our behalf. Our site is not directed at children under 13 and does not knowingly collect any personal information from children under 13.

All personal information is stored on our Internet database and/or servers. Access to personal information is limited to those individuals who are authorized to use such information for business and administrative purposes. Changes to the Personal Information We Have Collected.If you would like us to remove your personal information from our database, please send us an email request to privacy@autobrain.com Registered users of our site and service can access, review and edit their registration information, including login information, contact information, billing information and other suitable information, on our site. If you would like to delete your registration information, you can email us at privacy@autobrain.com Please be aware, however, that even after your request for deletion is processed, we may, for a time, retain residual information about you in backup and/or archival copies of our database.

Applicable Law The laws of the State of New York will govern this Privacy Policy without giving effect to any principles of conflict of law.

Effective Date and Modifications.This policy is effective as of October, 2015.
